V družbi TAXIN d.o.o. (mag. Franc Derganc), partnerici Mreže Modro Poslovanje preučujemo davčno-pravna in druga poslovno-pravna vprašanja na podlagi študija sodne prakse Sodišča EU in slovenskih sodišč, preučevati moramo pravne predpise EU in domače pravne predpise ter spremljamo "potrebe" strank - podjetij, ki delujejo v Republiki Sloveniji ter na t.i. mednarodnih trgih. 


Mreža modro poslovanje, na dnevnem nivoju, spremlja spremembe iz spodaj navedenih baz podatkov.

Odprava upravnega akta učinkuje za nazaj (ex tunc), to pomeni, da se odpravijo tudi posledice, ki so iz njega nastale. Postopek je ponovno odprt in vsi subjekti v postopku lahko (ponovno) uveljavljajo vse svoje procesne pravice. Četudi bi Vrhovno sodišče sledilo predlogu drugega pritožnika in pritožnice ter ugotovilo nezakonitost odločitve sodišča prve stopnje, da se njuni tožbi zavržeta, glede na siceršnjo odločitev sodišča prve stopnje o odpravi izpodbijanega akta, to ne bi izboljšalo njunega trenutnega pravnega položaja v obravnavanem upravnem sporu. Zato drugi pritožnik in pritožnica nimata pravnega interesa za vložitev pritožbe zoper odločitev sodišča prve stopnje, da se njuna tožba zavrže, saj si glede na siceršnjo odločitev sodišča prve stopnje svojih pravnih položajev v obravnavanem upravnem sporu v nobenem primeru ne moreta več izboljšati. Pritožba prvega pritožnika zoper odločitev sodišča prve stopnje o zavrženju tožbe drugega...
