V družbi TAXIN d.o.o. (mag. Franc Derganc), partnerici Mreže Modro Poslovanje preučujemo davčno-pravna in druga poslovno-pravna vprašanja na podlagi študija sodne prakse Sodišča EU in slovenskih sodišč, preučevati moramo pravne predpise EU in domače pravne predpise ter spremljamo "potrebe" strank - podjetij, ki delujejo v Republiki Sloveniji ter na t.i. mednarodnih trgih.

Nagrade za pregled dokumentacije in druga opravila, ki jih odvetnik napravi zato, da lahko sestavi vlogo ali da se pripravi za udeležbo na naroku, se ne obračunavajo in priznavajo posebej, ampak da so te storitve že vštete v siceršnji nagradi za opravilo, za katero je odvetnik pridobljene listine uporabil.

UPRS Sodba I U 1664/2021-8

Oporni zid je lahko cestni objekt in s tem sestavni del javne ceste ne glede na to, kdo je zemljiškoknjižni lastnik nepremičnine, na kateri stoji, tj. ne glede na to, ali je bila izvedena formalna razlastitev lastnika (dela) nepremičnine, na kateri je del cestnega sveta. Za odločitev je torej relevantno, ali je navedeni oporni zid konstrukcijsko povezan s cesto tako, da je bistven za obstoj ceste in je s tem njen del, ali pa gre za gradbeno samostojen objekt zemljišča parc. št. A. k.o. ..., tj. utrjuje to nepremičnino zato, da lahko tožnika nepremičnino uporabljata za namen, za katerega ga uporabljata. Tega dejstva toženka ni ugotavljala.

UPRS Sodba I U 630/2022-8

Iz izpodbijane odločbe izhaja, da je bila tožničina prijava na Javni razpis ocenjena s skupno 284 točkami. Kako je bila tožničina prijava ocenjena po posameznem merilu, iz izpodbijane odločbe ne izhaja. Iz izpodbijane odločbe prav tako ne izhaja konkretizirano zakaj tožničin projekt, kljub navedenemu številu točk in navedbi, da ustreza razpisnim merilom, ni bil sprejet v sofinanciranje.

UPRS Sodba I U 1224/2021-7

Tožnika utemeljeno opozarjata, da gre v obravnavanem primeru za odmero davka, ki se po določbah ZDoh-2 ne všteva v letno davčno osnovo in se šteje za dokončen davek. To pa pomeni, da pravna korist tožnikov glede obračuna in plačila davka, ki se nalaga družbi A. kot plačniku, ni zgolj posredna, saj se s tem, ker gre za dokončen davek, odloča tudi o pravnem temelju in o višini dohodninske obveznosti tožnikov kot zavezancev za dohodnino. To pa obenem pomeni, da tožnika, ne bosta imela možnosti, da se udeležujeta postopka odmere dohodnine ne v tem in tudi ne v drugem postopku, saj v ZDavP-2 ni predviden poseben postopek, v katerem bi bilo mogoče uveljavljati ugovore, ki se nanašajo na obračun davčnega odtegljaja.

UPRS Sodba I U 1011/2021-14

Tožnik je sporni aneks predložil prvič šele v pritožbenem postopku, kar pa je toženka zavrnila kot pritožbeno novoto po tretjem odstavku 238. člena ZUP. Tožnik tudi v tožbi ne pojasni razlogov, zakaj ni predložil aneksa že v postopku na prvi stopnji. ZDoh-2 v prvi vrsti napotuje na pogodbeno določeno vrednost nepremičnine, kar je davčni organ v obravnavani zadevi tudi konkretno pojasnil in ugotovil, da je vrednost predmetne nepremičnine ob pridobitvi razvidna iz listine - pogodbe o nakupu nepremičnine z dne 19. 6. 2019, iz katere izhaja, da je kupnina za odsvojeno nepremičnino znašala 65.000,00 EUR.
