Ker se osebna vročitev v skladu s prvim odstavkom 87. člena ZUP ni dala opraviti, je vročevalec vložil v tožnikov hišni predalčnik sporočilo o poizkusu vročitve, v katerem je pritožniku v skladu s tretjim odstavkom 87. člena ZUP obvestil, kje lahko v roku 15 dni zadevni sklep prevzame. Glede na to, da tožnik pošiljke v navedenem roku ni prevzel, se šteje, da je bil sklep tožniku osebno vročen s potekom 15-dnevnega roka za prevzem pisanja na pošti.
