V družbi TAXIN d.o.o. (mag. Franc Derganc), partnerici Mreže Modro Poslovanje preučujemo davčno-pravna in druga poslovno-pravna vprašanja na podlagi študija sodne prakse Sodišča EU in slovenskih sodišč, preučevati moramo pravne predpise EU in domače pravne predpise ter spremljamo "potrebe" strank - podjetij, ki delujejo v Republiki Sloveniji ter na t.i. mednarodnih trgih.

Ugotovitev, ali je izpolnjen pogoj, da vlagatelj ob vložitvi vloge na javni razpis nima neporavnanih davčnih obveznosti do države, je vezana na ugotovitev, za kakšno vrsto obveznosti v primeru evidentiranega dolga gre in nadaljnjo presojo, ali dolg iz naslova neporavnanih prispevkov za socialno varnost predstavlja davčno obveznost do države. V konkretni zadevi se ta pogoj ne nanaša na prispevke za socialno varnost, zato bi moral upravni organ pred izdajo izpodbijane odločbe ugotoviti vir oziroma vrsto dolgovane obveznosti.
