V družbi TAXIN d.o.o. (mag. Franc Derganc), partnerici Mreže Modro Poslovanje preučujemo davčno-pravna in druga poslovno-pravna vprašanja na podlagi študija sodne prakse Sodišča EU in slovenskih sodišč, preučevati moramo pravne predpise EU in domače pravne predpise ter spremljamo "potrebe" strank - podjetij, ki delujejo v Republiki Sloveniji ter na t.i. mednarodnih trgih. 


Mreža modro poslovanje, na dnevnem nivoju, spremlja spremembe iz spodaj navedenih baz podatkov.

VSRS Sodba III Ips 33/2023

Vse udeležence pravnih razmerij zavezujejo temeljna pravna načela, med drugimi načelo poštenega izvrševanja pravic, ki vključuje prepoved ravnanja v nasprotju z opravljenim (venire contra factum proprium). Načelo poštenega izvrševanja pravic in obveznosti, zaobseženo na področju obligacijskega prava v načelu vestnosti in poštenja (5. člen OZ), ki je imanentna omejitev svobode ravnanja na področju sklepanja obligacijskih razmerij ter pri izvrševanju pravic in obveznosti iz teh razmerij, zavezuje in pooblašča sodišče, da pravna pravila razlaga z ozirom nanj. Kadar izjava o odpovedi, ki bi lahko sprožila svojevoljno prenehanje pogodbe o ustanovitvi stvarne služnosti, z vidika načela poštenega izvrševanja pravic ni sprejemljiva, kot je to v obravnavanem primeru, izjavi o odpovedi ni mogoče priznati učinkov, ki jih ureja 333. člena OZ. Sklicevati se na domnevno pravico, kadarkoli z izjavo o odpovedi služnostne pogodbe sprožiti...
