V družbi TAXIN d.o.o. (mag. Franc Derganc), partnerici Mreže Modro Poslovanje preučujemo davčno-pravna in druga poslovno-pravna vprašanja na podlagi študija sodne prakse Sodišča EU in slovenskih sodišč, preučevati moramo pravne predpise EU in domače pravne predpise ter spremljamo "potrebe" strank - podjetij, ki delujejo v Republiki Sloveniji ter na t.i. mednarodnih trgih. 


Mreža modro poslovanje, na dnevnem nivoju, spremlja spremembe iz spodaj navedenih baz podatkov.

UPRS Sklep I U 1636/2021-21

Zgolj v primeru, da je s popravnim sklepom poseženo v pravni položaj, ima stranka možnost izpodbijanja takšnega sklepa kot sklepa o končanju postopka odločanja o popravi odločbe v upravnem sporu, saj gre le v takšnem primeru za sklep iz drugega odstavka 5. člena ZUS-1; če popravki ne vplivajo na pravni položaj, torej na pravice in obveznosti stranke, pa sklep o popravi pomote ni akt, ki bi se lahko izpodbijal v upravnem sporu. Pravni pouk v izpodbijanem sklepu, ki tožnika izrecno napotuje na možnost upravnega spora, sam po sebi za to presojo ni merodajen.

UPRS Sodba I U 573/2021-9

V tretjem odstavku 79. člena ZDavP-2 je določeno, da gredo stroški davčnega postopka, kot so: izdatki za upravne takse, pravno svetovanje in strokovno pomoč, izdatki za priče, izvedence, tolmače in ogled, v breme davčnega organa, če se je postopek končal ugodno za zavezanca za davek, oziroma v breme zavezanca za davek, če se je postopek zanj končal neugodno. ZDavP-2 torej ne govori o napaki davčnega organa, pač pa o ugodno zaključenem postopku za davčnega zavezanca. Da se je v konkretnem primeru zaradi ugovora tožnika zoper informativni izračun dohodnine zanj postopek zaključil ugodno, pa med strankama ni sporno.

UPRS Sodba I U 284/2021-10

Po podatkih, ki jih je davčni organ prejel od pristojnih organov (340. člen ZDavP-2), je bil tožnik po stanju na dan 30. 6. 2019 lastnik kmetijskih in gozdnih zemljišč, za katera mu je bil pripisan katastrski dohodek v višini 149.27 EUR. V letu 2019 je tožnik od Agencije RS za kmetijske trge prejel tudi subvencijo v višini 355,75 EUR, ki se v skladu s 70. členom ZDoh-2 šteje za dohodek iz osnovne kmetijske in osnovne gozdarske dejavnosti.
